General terms and conditions
1 Definitions
1.1 The Instructor/Coach: Martine Tondeur
1.2 The Participant or Client: the natural or legal person who instructs the Instructor/Coach to provide services.
1.3 Services: training courses, courses, group supervision and coaching and/or consultancy provided by Martine Tondeur to the participant/client within the agreed period/time block.
1.4 The start of a service is the start time on the agreed delivery date of the service and the end time of a service is the end time on the end date as agreed between the Instructor/Coach and the Participant/Client.
2 Applications
2.1 These general terms and conditions apply to all quotations made by the Instructor/Coach and to all agreements concluded by the Instructor/Coach with the Participant/Client.
2.2 The applicability of delivery and/or other terms and conditions of the participant/client is hereby expressly rejected, unless otherwise agreed in writing.
3 Execution, registration, cancellation & payment
3.1 Martine Tondeur services are performed by certified PSYCH-K® instructors and/or under the supervision of Martine Tondeur.
3.2 Courses/trainings/courses only start with full groups. In case of incomplete groups, the Participant/Client will be contacted for an alternative date.
3.3 A registration for a course/training/training is valid via the registration form filled in by the Participant/Client on the website: www.myceleste.eu by which Participant/Client automatically agrees to the General Terms and Conditions of Martine Tondeur and the other agreements made by e-mail correspondence between the Instructor/Coach and the Participant/Client.
3.4 When registering for a service a time to consider of 14 days applies for the Participant/Client. The date of registration applies as stated by the Instructor/Coach upon entry.
3.5 When registering for a course/workshop/training, a cancellation fee of 15% of the entire invoice amount of the service applies from 30 days prior to the first course/workshop/training date, even if payment in installments has been agreed.
3.6 When registering for a course/education/training, 50% cancellation costs of the entire invoice amount of the service from 15 days prior to the first course/workshop/training date, even if payment in installments is agreed.
3.7 When registering for a course/education/training, 100% cancellation costs of the entire invoice amount of the service from 8 days prior to the first course/education/training date, even if payment in installments is agreed.
3.8 In the event of a mutually agreed individual coaching arrangement, 100% cancellation costs apply for the relevant coaching session from 72 hours or less prior to the date and time of the coaching session. This also applies to the non appearance of the Coachee and/or Participant/Client, for whatever reason, whereby travel costs incurred will also be charged.
3.9 In case of illness, injury or any other reason of the Participant/Client during the service and/or training/education/course period, no refund of (part of) the invoice amount will be granted.
3.10 If one of the Trainers/Teachers/Coaches is ill or injured on the agreed service date/dates, an alternative date will be looked for and submitted.
3.11 When registering for a service with the Instructor/Coach the amount due must be transferred to IBAN bank account number BE26 7390 2057 6529 in the name of Martine Tondeur, Scherpenheuvel, based on the name of the service, name of the Participant and/or company and invoice number before or on the agreed payment (term) date/dates.
3.12 In the event of later payment than stated under 3.11, the Participant/Client is automatically in default and default interest of at least 2% of the entire invoice amount concerned is due for each month that the Participant/Client is in default of payment.
3.13 Participant/Client will have to pay both extrajudicial and legal costs incurred to collect the outstanding invoice, with a minimum of 10% of the invoice value.
3.14 The Instructor/Coach is entitled to refuse Participants without giving reasons.
3.15 Participant/Client allows photo, film and/or sound material made during the training/education/course to be used for promotional purposes. If a Participant does not want this, he/she must inform the Instructor/Coach in writing and this is valid at the time that the Instructor/Coach has sent a confirmation of receipt of this message to the Participant/Client.
4 Liability & complaints procedure
4.1 The Instructor/Coach is not liable, except in the case of intent or gross negligence on the part of the Instructor/Coach, for any direct and/or indirect damage caused by whatever cause in the, or as a result of the execution or non-execution of the order. The liability is limited to a maximum of the amount of the compensation for the services to be provided.
4.2 The Instructor/Coach is not liable, except in the case of intent or gross negligence on the part of the Instructor/Coach, for any direct and/or indirect damage caused by whatever cause to the property of the Participant/Client and/or participant. The liability is limited to a maximum of the amount of the compensation for the services to be provided.
4.3 The Instructor/Coach is not liable, except in the case of intent or gross negligence on the part of the Instructor/Coach, for any direct damage suffered by the Participant/Client and/or Participants as a result of the failure to carry out the assignment.
4.4 Participant/Client indemnifies the Instructor/Coach against all claims by third parties on account of this Instructor/Coach, unless there is gross negligence or intent on the part of the Instructor/Coach.
5 Intellectual Property
5.1 Without the express written consent of the Instructor/Coach, the Participant/Client is not entitled to disclose, exploit or in any way reproduce data from and/or parts and/or excerpts of the training material provided.
5.2 The intellectual property 'copyright' of the training and course material belongs entirely to the Instructor/Coach.
6 Confidentiality and Secrecy
6.1 The provided privacy information will not be shared with third parties and will be treated confidentially.
6.2 Each Participant in education/workshops/courses commits to the rules of privacy. This means that all stories of a personal nature must be treated confidentially. Participants in the education/workshops/course may discuss this among themselves. Participants in the education/workshops/course may not bring personal stories outside the environment of the education/workshops/course, unless the person in question has given explicit permission.
7 Applicable law:
To all offers, general offers, (legal) acts and such of the Instructor/Coach and agreements between the Instructor/Coach and Participant/Client, Belgian law and the jurisdiction of the Belgian courts is applicable.
